CITY OF PEWEE VALLEY, KENTUCKY

ORDINANCE #8, SERIES 2009

 

AN ORDINANCE RELATING TO THE CLOSURE OF TANGLEWOOD PLACE AND A PORTION OF ALLEN AVENUE

 

WHEREAS, the City of Pewee Valley has the authority pursuant to KRS 82.405 to close in whole or in part a city street, such as Tanglewood Place and Allen Avenue; and

 

            WHEREAS, Oldham County Planning Commission on June 23rd, 2009 (Docket Number PZ-09-003) has recommended in favor of said closures, the roadway in question having never been built since being platted in 1915 and having been in use as yards for that time period and;

 

            WHERAS, all property owners in or abutting the public way or portion thereof being closed have given their written notarized consent to the closing and copies of the consent are attached hereto,

 

            NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF PEWEE VALLEY:

 

  1. The City of Pewee Valley does hereby elect to close all of Tanglewood Place and a portion of Allen Avenue, as shown in Exhibit A.  This decision to close said roadways has been made after the Pewee Valley Council made the following findings of fact:

 

(a)                The City has identified all property owners in or abutting the public way or portion thereof to be closed has been made; and

 

(b)               Notice of the proposed closing was given to all property owners in or abutting the public way or portion thereof being closed, and

 

(c)                All property owners in or abutting the public way or a portion thereof being closed have given their written notarized consent to the closing.  Copies of the consent are attached hereto as Exhibit B.

 

  1. The decision to close the above described roadway has been made by the City of Pewee Valley pursuant to the statutory authority of KRS 82.405.

 

  1. The City of Pewee Valley has provided procedural and substantive due process in completing the procedure permitted under KRS 82.405

 

  1. This ordinance shall take effect upon its reading, passage and publication, in accordance with law.
