ORDINANCE #9, SERIES 2009

 

AN ORDINANCE CONVERTING A SECTION OF HOUSTON LANE

TO ONE-WAY TRAFFIC

 

WHEREAS, the City of Pewee Valley has the authority pursuant Kentucky Revised Statutes to establish traffic regulations on its City Streets, and

 

            WHEREAS, the City desires to have the railroad quiet zone extended from the Jefferson County boundary to the Houston Lane crossing and to do so requires the Houston Lane crossing to be made one-way,

 

            NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF PEWEE VALLEY:

 

  1. The City of Pewee Valley does hereby elect to establish one-way traffic on Houston Lane, at the point where Houston Lane crosses the railroad adjacent to Highway 146.  Such one-way designation shall allow traffic to exit the City onto Highway 146, but not allow traffic to enter onto Houston Lane from Highway 146.  The one-way designation, improvements and signage shall be as shown on the attached Exhibit One, designed by City Engineer Mel Milburn.

 

  1. In support of its decision to establish one-way traffic at the Houston Lane crossing, the City of Pewee Valley further makes the following Findings of Fact:

 

(a)                There is a pending application to create a quiet zone for the railroad adjacent to Highway 146, through the railroad crossings at Westport Road, LaGrange Road and Altwood Court.

 

(b)               The City of Pewee Valley has investigated extending the quiet zone through the Houston Lane crossing and has found that the only feasible way to apply for quiet zone status is to make the one-way designation described above.  There are only five improvements to the gate allowed by Federal law that would qualify the gate for quiet zone status.  Of the five improvements, the City finds that making it a one-way is the only solution that is possible and practical.

 

(c)                The City commissioned a licensed engineer (Mel Milburn) to design the one-way improvements and signage, in order to make the crossing as safe as possible.  The City also commissioned a traffic engineer to analyze the traffic impact of the one-way designation to both the Houston Lane crossing and the next crossing at Central Avenue.  The traffic engineer took traffic counts and issued the attached letter, which  found the one-way designation at the Houston Lane crossing was safe and in addition that said designation will not significantly impact the Central Avenue crossing.  The traffic engineer’s opinion is attached as Exhibit Two.

 

 

  1. This ordinance shall take effect from its passage, approval and publication as required by law.
