Board Of Adjustments
Each of the member governments of Oldham County Planning and Zoning (i.e., Pewee Valley, Crestwood, LaGrange and Oldham County Fiscal Court) has its own Board of Adjustments (KRS 100.217). The Pewee Valley Board of Adjustment is composed of five (5) members appointed by the mayor with the approval of the city council (KRS 100.217). Meetings of the Board are at the call of the chairman (KRS 100.221).The Pewee Valley Board of Adjustments has exclusive jurisdiction for all land use issues within the geographic boundaries of Pewee Valley. The purpose of the Board of Adjustments is to grant relief from the literal enforcement of the Oldham County Zoning Ordinance. Two forms of relief are permitted: (a) the Board may grant a conditional use permit, subjecting the regulations to reasonable requirements (KRS 100.237); or (b) the Board may grant a variance, permitting a property owner to depart from certain requirements (KRS 100.241).
The Pewee Valley Board of Adjustments also has the power to hear and decide cases where it is alleged by an applicant that there is an error in any order, requirement, decision, grant or refusal made by an administrative official in the enforcement of the zoning regulation regarding property within the city limits of Pewee Valley (KRS 100.257).
The Board of Adjustments may impose any reasonable conditions or restrictions on any variance it decides to grant. In addition, the Board may permit the enlargement or extension of a nonconforming use which had existed at the time the zoning ordinance was enacted, provided such use had been a nonconforming use for ten years will be deemed approved as a valid nonconforming use (KRS 100.253).
In addition to establishing a board of adjustment, the City may designate an official to administer the zoning regulations. This official may also be delegated responsibility as administrator of housing or building regulations (KRS 100.271).

- Conditional Uses - The zoning ordinance lists specific uses for property that are allowed in certain zoning districts. The Board has the power to place conditions on the approval so as to make the application compatible with the neighborhood. - Variances - The zoning ordinance has specific requirements for the development or construction of property. The Board has the power to grant a variance from the literal enforcement of the zoning ordinance. For example, a building may be constructed closer to a property line than normally is allowed with a variance. (KRS 100.241)
- Appeals -Any person who feels aggrieved or injured by a decision or action of the county administrator or other zoning official regarding property within the city limits of Pewee Valley, may appeal that decision or action to the Pewee Valley Board of Adjustments. (KRS 100.257)
